Opportunities and limitations in UK climate change litigation: The Boswell case

PhD researcher Millie Prosser and Friends of The Earth Lawyer and PhD researcher Acland Bryant are joined by the renowned environmental lawyer David Wolfe KC and Norwich-based climate litigator Dr Andrew Boswell, to discuss their current case in the Court of Appeal. Their case challenges government decision-making on three large road infrastructure projects for failing to include a cumulative assessment of GHG emissions. Through the lens of this case the podcast considers the role and legitimacy of climate litigation in the UK, the constitutional significance of climate-related judicial review cases and citizen routes to scrutiny and accountability of government decision-making. Asking what climate litigation cases such as Andrew’s can achieve, directly or indirectly, within the UK’s current climate governance framework.
