In order to maintain excellence in service provision it is essential that health care professionals possess a general understanding of law and ethics relating to health care. A well structured, broad examination of this area of law and ethics will enable the professional to apply general legal and ethical principles to their own area of practice.  This module has been designed to give health care professionals a working knowledge of health care law and ethics as it relates to their practice.

What will I learn?

  • Overview of health care law in relation to the law generally, enabling critical reflection on the vital role of law in all aspects of public and private life.
  • Overview of health care ethics. Theories, principles, frameworks, models, the language and history of health care ethics enabling the development of the ability to challenge assumptions, discuss contentious, complex viewpoints, evaluation of the role of ethical reflection in health care delivery.
  • Medical Negligence and the Standard of Care. Developing a clear understanding of these legal concepts and their interrelatedness with ethical practice will foster a reduction in defensive practice thus enhancing knowledgeable, questioning practice and the continuous strive towards service improvement.
  • Paternalism versus autonomy – law and ethics. It is vital that students identify the broad distinctions in the study of ethics as identified similarly below.
  • Utilitarianism versus deontology - as above.
  • Confidentiality and Data Protection – law and ethics - as with the study of ethics the broad divisions and conflicts in the study of health care law demand critical exploration in relation to the realities of practice.
  • Consent to treatment and research – law and ethics. This seminal topic lies at the heart of health care ethics and law and repays a deeper depth of study than merely following published guidelines.  The law is never static and advances in case law related to consent reflect current ethical debate.Legal and ethical issues at the beginning and end of life. Fundamental principles of ethics and law are applied to these key, complex areas of health care practice.
  • Human Rights:- this topic is explored throughout the module and clarification and contextualisation of this concept within the broader context of health care law and ethics enables perspective and understanding of this often misunderstood topic.
  • Organ and tissue donation and transplantation - law and ethics. This topic is of general and specific interest depending on students’ area of practice, but it also demonstrates the responsiveness of the law to changing attitudes and challenges assumptions within the discussion of ways of increasing the supply of organs for transplantation.
  • Ethical and legal issues in resource allocation in health care. This perennial issue within health care delivery is subjected to structured legal and ethical scrutiny and academic debate.
  • Ethical concept of personhood - as above, this ethical concept is examined with reference to ethical theoretical principles and frameworks.
  • Legal and Ethical Issues in Reporting Concerns in Practice –“ whistle blowing”, public interest disclosure. Critical exploration of the realities of public interest disclosure in relation to legal developments enables honest appraisal of professional and personal moral stances.
  • Ethical decision-making in practice, principles, frameworks, moral theoretical concepts are applied to the realities of practice.
