Recording broadcasts; Copying audio and video recordings and films

BROADCASTS AND CABLE PROGRAMMES can be recorded off-air for educational purposes. At UEA most off-air recording is subject to licence.

THE EDUCATIONAL RECORDING AGENCY (ERA) licenses UEA to make off-air recordings for educational purposes of programmes broadcast by

  • BBC (excluding OU programmes)
  • Independent Television Association (ITA)
  • Channel Four TV
  • Channel Five TV
  • Sianel Pedwar Cymru.

Under the ERA licence any type of programme can be recorded and retained indefinitely, and copies of the recordings can be made. There is no restriction on where the recordings can be made but they must be made by UEA staff.

Extracts or entire programmes can be recorded and compilations of extracts made and edited. Editing does not mean that the material recorded can be adapted, by separating pictures from soundtrack or by substituting or adding commentary. These activities are not allowed.

Recordings can be shown to UEA staff and registered students, but they cannot be shown to either a public or private audience that has paid to view them.

Recordings should not be loaned unless viewing for educational purposes can be guaranteed. If they are loaned, a written declaration to this effect should be obtained first.

OPEN UNIVERSITY (OU) programmes are recorded under a separate licence with different terms and conditions.

Unencrypted SATELLITE and OTHER BROADCASTS not covered by the ERA and OU licences can be recorded on a similar basis to the terms of the ERA licence.

FILMS and VIDEOS can be copied in the course of teaching the techniques of making films and film soundtracks by those giving or receiving instruction, but not for teaching purposes generally.

FILMS, VIDEOS, and SOUND RECORDINGS can be copied for examination purposes in general and in respect of criticism, review and news reporting.

There is no 'fair dealing' arrangement allowing the copying of films, videos and sound recordings for private study and research without the copyright owner's explicit consent.
